Article 4: Delivery and Shipping Costs

Bank's Skateshop may be exempted from this liability if proof is provided that the non-performance or poor performance of the contract is attributable either to the carrier, or to the customer, or to the fact, unforeseeable and insurmountable, of a third party to the contract, or to a case of force majeure.

If, when checking the goods, it appears that they do not comply with the order form or that they have been damaged during transport, Bank's Skateshop encourages the customer to refuse them and to make express reservations. on the delivery slip.

Receipt of the complete order cancels any action against the carrier for damage or partial loss if within three days, not including public holidays, which follow that of this receipt, the recipient has not notified the carrier, by extrajudicial act or by registered letter, his explicit protest. A copy of this letter should be sent to Bank's Skateshop for information.

When the customer personally takes delivery of the objects transported and when the carrier does not justify having given him the possibility of actually checking their good condition, the time limit for action against the carrier is extended to ten days (article L. 121-105 of the consumer code ).

In the event of a delay in delivery of more than 48 working hours from the date of taking the order, the customer may apply articles L. 138-2 and L 138-3 of the consumer code .

General information on delivery: After confirmation of order and payment, Bank's Skateshop undertakes to deliver to its carrier, all the references ordered by the buyer and this within 48 hours worked or worked by our carrier. This carrier undertakes by contract with Bank's Skateshop to deliver the order to the buyer's address provided by Bank's Skateshop from Monday to Friday (excluding public holidays).

For deliveries outside the European Community, deliveries are made by UPS (unless specifically requested by the customer). War, riots, fire, strikes, accidents and the impossibility of being supplied are considered as cases of force majeure releasing the seller from his obligation to deliver. The goods always travel at the recipient's risk and peril. Always check your package upon arrival. You have a period of 48 hours to make any reservations with the carrier in the event of missing items or damage.

For reasons of availability, an order may be delivered in several installments to the customer. The customer only pays for one delivery. If the customer wishes 2 places of delivery, he places 2 orders, with the respectively related delivery costs.

Article 5: Price

The prices displayed on www.banks-skateshop.com are indicated in euros all taxes included (VAT applicable on the day of the order), excluding postage.

The price charged is the price indicated on the order confirmation sent by Bank's Skateshop including the price of the item(s), packaging and transport costs.

Bank's Skateshop reserves the right to modify its prices at any time but undertakes to apply the prices in force which will have been indicated at the time of the order, subject to availability on that date.

Bank's Skateshop retains ownership of the products until full payment of the price by the customer.

Article 6: Discounts and promotion codes

If a discount code or promotion code is used, we reserve the right to ask for proof (FFRS license, Hop'la association membership card, etc.). Article 7: Disputes

This contract is subject to French law. The same applies to any modifications to the products resulting from the manufacturers. The responsibility of Bank's Skateshop will, in any event, be limited to the amount of the order and cannot be blamed for simple errors or omissions which may have remained despite all the precautions taken in the presentation of the products. In the event of difficulties in the application of this contract, the buyer has the possibility, before any legal action, to seek an amicable solution, in particular with the help of a professional association in the branch, a consumer association or any other counsel of his choice. It is reminded that the search for an amicable solution does not interrupt the “brief period” of the legal guarantee, nor the duration of the contractual guarantee. It is recalled that as a general rule and subject to the judgment of the Courts, compliance with the provisions of this contract relating to the contractual guarantee assumes that the buyer honors his financial commitments to the seller.

Complaints or disputes will always be received with attentive benevolence, good faith being always presumed in those who take the trouble to explain their situations. In the event of a dispute, the customer will first contact the company to obtain an amicable solution.

Failing this, the Commercial Court of Mont-de-Marsan (Landes), has sole jurisdiction, regardless of the place of delivery and the method of payment accepted.

Article 8: Guarantee

Bank's Skateshop guarantees that all selected products are distributed by our suppliers in Europe. In all cases Bank's Skateshop cannot be held responsible for non-compliance with the regulations and laws in force in the country of receipt, the responsibility of Bank's Skateshop is systematically limited to the value of the product in question, value on its date of sale and this without the possibility of recourse to the brand or the company producing the product.

In any case, the customer benefits from the legal guarantee of eviction and hidden defects (Art.1625 and following of the Civil Code). On condition that the buyer proves the hidden defect, the seller must legally repair all the consequences (art. 1641 and following of the civil code); if the buyer goes to court, he must do so within a “short time” from the discovery of the hidden defect (art. 1648 of the civil code).

Article 9: Legal information
